Terms of Use

1. Agreement and operator

These Terms form an agreement between you and Anand Nishad, the independent developer and operator of FemlyCare. No registered company is represented as the operator. By creating an account and selecting acceptance, you confirm that you have read and agree to these Terms and the Privacy Policy. If you do not agree, do not use the account, cloud sync, or AI service.

2. Eligibility

You must be at least 18 years old and legally able to enter this agreement. FemlyCare is not offered to children. You must provide accurate eligibility confirmation and keep account credentials secure.

3. What FemlyCare provides

FemlyCare allows users to record menstrual cycle dates, symptoms, flow, pain, mood, notes, reminders, estimates, and general wellness conversations. Predictions are estimates based on data supplied by the user and may be inaccurate, especially for irregular cycles or incomplete records.

4. Not medical advice or a medical device

• FemlyCare does not diagnose, treat, cure, prevent, monitor, or manage a disease or medical condition.
• Cycle estimates must not be used as contraception, fertility treatment, or a diagnosis of pregnancy or infertility.
• Do not delay professional care because of app content. Contact a qualified healthcare professional for symptoms, diagnosis, medication, pregnancy, fertility, sexual health, or STI questions.
• For severe pain, very heavy bleeding, fainting, breathing difficulty, assault, self-harm risk, or another emergency, contact local emergency services immediately.

5. AI limitations

AI responses are generated by OpenAI from your message and limited relevant context after explicit consent. They may be incomplete, outdated, biased, or incorrect. FemlyCare's AI provides general wellness information only. It does not provide pregnancy, contraception, sexual-health, or STI guidance; diagnose conditions; prescribe medication or dosage; or guarantee an outcome. You remain responsible for decisions and should verify important information with a qualified professional.

6. Account, consent, and cloud sync

After successful login, the app displays required consent choices. Acceptance records current age, Privacy Policy, Terms, health-data cloud sync, and AI-processing consent, writes cloudSyncConsent: true, and starts synchronization automatically. There is no separate cloud-sync switch in Settings. If you do not provide required consent, the authenticated service is not activated. Optional analytics and crash reports remain separate and off by default.

You may delete app data while keeping the account, or delete the full account, through Privacy Settings. Account deletion is intended to be permanent. Keep your own export where needed before deletion.

7. Acceptable use

You must not:

• use the app for unlawful, abusive, fraudulent, threatening, exploitative, or harmful activity;
• attempt to bypass age, consent, authentication, App Check, quotas, security, or access controls;
• access another person's account or upload another person's health data without lawful authority;
• reverse engineer, disrupt, overload, scrape, or introduce malicious code except where mandatory law expressly permits;
• present AI output or cycle estimates as professional medical advice or emergency instructions.

8. Your content and privacy

You retain rights in information you submit. You grant the operator and contracted processors a limited, non-exclusive right to host, transmit, transform, and process it only to provide, secure, maintain, and legally operate FemlyCare. Data handling, processors, transfers, retention, and rights are described in the Privacy Policy.

9. Intellectual property

The app software, design, text, graphics, and branding are owned by the operator or applicable licensors, subject to third-party open-source licenses. These Terms grant only a personal, limited, revocable, non-transferable right to use the app lawfully. They do not grant ownership of FemlyCare branding.

10. Availability, changes, and termination

The service may change, be suspended, or be discontinued for maintenance, security, legal, provider, or product reasons. Features and limits may change with reasonable notice where required. The operator may suspend access for material breach, abuse, security risk, or legal necessity. You may stop using the service and delete your account at any time.

11. Charges

FemlyCare currently does not offer an active paid upgrade or manual UPI payment flow. If paid features are introduced, price, billing provider, renewal, cancellation, and refund terms will be shown before purchase and will follow applicable app-store and consumer rules.

12. Disclaimers and liability

To the maximum extent permitted by law, the service is provided "as is" and "as available," without a guarantee of uninterrupted availability, accuracy, fitness for a particular purpose, or medical outcome. The operator is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of estimates, AI output, third-party services, or unavailable service.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, or death/personal injury caused by negligence where applicable. Mandatory consumer protections in your country remain unaffected.

13. Indemnity

Where permitted by law, you agree to reimburse reasonable losses caused by your unlawful misuse of the service, infringement of another person's rights, or material breach of these Terms. This does not apply where prohibited by consumer law.

14. Governing law and disputes

These Terms are governed by the laws of India, and courts with jurisdiction over the operator's location in India will have jurisdiction, except that consumers in the EU/EEA, UK, or another country retain any mandatory local consumer protections and rights to bring claims in courts available under applicable law. 15. General terms

If a provision is unenforceable, the remainder continues. A failure to enforce a provision is not a waiver. You may not transfer this agreement without consent; the operator may transfer it only with the service and subject to applicable notice and privacy obligations. Material revisions receive a new version date and may require renewed acceptance.
